1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and RipFit180 Inc. ("Company," "we," "our," or "us") regarding your use of our website at www.ripfit180.com, mobile application, products, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

2. Acceptance and Changes

2.1 Acceptance

By using our Services, you represent that:

  • You are at least 18 years old, or have parental/guardian consent if between 13-18

  • You have the legal capacity to enter into these Terms

  • Your use of the Services will not violate any applicable laws or regulations

2.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms on our website

  • Sending email notification to registered users

  • Providing notice through our Ripfit180 online training

Continued use of our Services after changes constitutes acceptance of the new Terms.

3. Description of Services

RipFit180 provides:

  • Physical fitness equipment (RipFit180 devices and accessories)

  • RipFit180 Online Training, including Foundation access and optional Performance training

  • Digital content including workout videos, setup guidance, training resources, and movement education

  • Customer support and related services

4. Account Registration and Security

4.1 Account Creation

To access certain features, you must create an account by providing:

  • Accurate and complete information

  • Current email address and contact information

  • Secure password

4.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities that occur under your account

  • Notifying us immediately of any unauthorized use

4.3 Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms

  • Provide false or misleading information

  • Engage in fraudulent activities

  • Abuse our Services or other users

5. Orders and Purchases

5.1 Product Orders

When placing an order, you agree that:

  • All product information is accurate

  • Prices are subject to change without notice

  • We reserve the right to limit quantities

  • Orders are subject to acceptance and availability

5.2 Pricing and Payment

  • All prices are displayed in USD unless otherwise specified

  • Payment is required at time of order

  • We accept major credit cards, PayPal, and other payment methods

  • You authorize us to charge your payment method for all purchases

5.3 Order Acceptance

We reserve the right to:

  • Refuse or cancel any order

  • Limit order quantities

  • Discontinue products at any time

  • Correct pricing errors

6. Shipping and Delivery

6.1 Shipping

  • Shipping costs are included in product pricing ("shipping already paid for")

  • Delivery times are estimates and may vary

  • Risk of loss passes to you upon delivery

  • You are responsible for providing accurate shipping information

6.2 International Shipping

For international orders:

  • Additional customs fees or duties may apply

  • Delivery times may be extended

  • Some products may not be available in all countries

7. Returns and Refunds

7.1 30-Day Performance Guarantee

We offer a 30-day performance guarantee on all RipFit180 devices:

  • Products must be returned in original condition

  • Return shipping costs are the customer's responsibility

  • Refunds will be processed within 10 business days

  • Digital content and RipFit180 Online Training memberships are non-refundable after 30 days.

7.2 Return Process

To initiate a return:

  1. Contact customer support at support@ripfit180.com

  2. Receive return authorization and instructions

  3. Package and ship product according to instructions

  4. Allow 10 business days for refund processing

7.3 Warranty Claims

Our products include:

  • Lifetime band warranty (with active PerformanceRipfit180 online training membership)

  • 1-year warranty on device frame and components

  • Warranty covers manufacturing defects, not normal wear, misuse, improper setup, over-stretching, unsafe use, or failure to follow safety instructions

8. RipFit180 Online Training and Digital Content

8.1 Online Training Access

RipFit180 Online Training may include:

  • Foundation access included with eligible RipFit180 device purchases

  • Optional RipFit180 Performance training membership

  • Training videos, setup guidance, movement education, community access, and related digital resources

  • Access to additional training content, programming, challenges, and support depending on membership level

  • RipFit180 Foundation is intended to help users get started with setup, anchoring, safety, and movement basics.
  • RipFit180 Performance is an optional paid upgrade that may include advanced programming, sport-specific training, additional workouts, challenges, Q&A, community features, and future training drops.

8.2 Performance Membership and Cancellation

RipFit180 Performance is an optional paid training membership.

  • Performance membership pricing, billing terms, renewal terms, and cancellation options will be provided at the time of signup.

  • You may cancel your Performance membership through the applicable account settings or billing platform used to manage your membership.

  • Cancellation takes effect according to the billing terms provided at signup.

  • No refunds are provided for partial billing periods unless required by law or otherwise stated in writing by RipFit180.

    8.3 Content License

We grant you a limited, non-exclusive license to:

  • Access and use RipFit180 Online Training content for personal use

  • View training videos, setup guidance, workout materials, and related digital resources

  • Use content in accordance with these Terms and any applicable platform rules

You may not:

  • Share, distribute, or resell digital content

  • Provide your account access to another person

  • Use RipFit180 training content for commercial purposes

  • Record, download, scrape, or republish training content unless expressly permitted

9. Intellectual Property Rights

9.1 Our Rights

RipFit180 owns all rights to:

  • RipFit180 trademarks and brand names

  • Patented technology and designs

  • Website content and online training platform features

  • Training programs and methodologies

9.2 User Content

If you submit content (reviews, photos, videos), you grant us:

  • Non-exclusive right to use, display, and distribute your content

  • Right to use your name and likeness in connection with content

  • Perpetual license to use content for marketing and promotional purposes

9.3 Respect for IP Rights

You agree not to:

  • Infringe on intellectual property rights

  • Use our trademarks without permission

  • Copy or reverse engineer our products

  • Create derivative works based on our content

10. Prohibited Uses

You may not use our Services to:

  • Violate any laws or regulations

  • Infringe on rights of others

  • Transmit harmful or malicious content

  • Engage in fraudulent activities

  • Interfere with Service functionality

  • Collect user information without consent

  • Use automated systems to access Services

11. Health and Safety

11.1 Medical Disclaimer

RipFit180 products, training content, and related materials are provided for general fitness, educational, and informational purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition and do not constitute medical advice.

You should consult a qualified healthcare provider before starting any new exercise program, especially if you have a medical condition, injury, mobility limitation, are pregnant, or have concerns about your ability to safely exercise.

11.2 Assumption of Risk

Use of fitness equipment, resistance bands, and exercise programs involves inherent risk. By using RipFit180 products, you acknowledge and accept the risks associated with physical exercise, resistance training, equipment use, and improper setup or misuse.

You are responsible for using RipFit180 safely, following all instructions, and exercising within your own ability and limits.

11.3 Equipment Inspection Before Use

Before each use, you must carefully inspect all RipFit180 bands, handles, clips, straps, anchors, attachment points, and device components.

Look for any signs of wear, cracks, cuts, holes, tears, fraying, stretching, weakness, loose connections, damaged stitching, or other defects.

Do not use the product if any part appears damaged, worn, altered, or unsafe.

11.4 Maximum Pull Distance

Users must never pull the resistance bands beyond the recommended maximum training distance.

The maximum pull distance is 7 feet / 2.13 metres unless otherwise specifically instructed by RipFit180.

If additional resistance is needed, users must add another band rather than over-stretching a single band beyond the recommended distance.

11.5 Proper Anchoring and Setup

Users must ensure the RipFit180 device is properly anchored and secured before beginning any exercise.

Do not attach the product to unstable, weak, sharp, moving, damaged, or unsafe objects. Doors, walls, furniture, trees, posts, and other anchor points must be strong enough to safely withstand resistance and pulling force.

11.6 Band Recoil and Safe Positioning

Users must keep their face, head, neck, and body out of the direct recoil path of the bands.

Resistance bands may snap back if released, overstretched, improperly attached, damaged, or used incorrectly.

11.7 Safe Exercise Area

RipFit180 should only be used in a clear, open area with adequate space.

Keep children, pets, and bystanders away from the exercise area while the product is in use.

11.8 Proper Use

RipFit180 must only be used as instructed.

Do not use RipFit180 while distracted, under the influence of alcohol or drugs, or in any way that affects balance, coordination, judgment, or physical control.

Stop exercising immediately if you experience pain, dizziness, shortness of breath, discomfort, or any unusual symptoms.

11.9 Age Restrictions and Supervision

Users under 18 require parental or guardian supervision.

RipFit180 should be used by one person at a time and should be kept away from small children when not in use.

11.10 Misuse and Liability

Misuse, improper anchoring, over-stretching, damaged bands, unsafe surroundings, failure to inspect equipment, or failure to follow instructions may result in injury or property damage.

To the maximum extent permitted by law, RipFit180 is not responsible for injuries, damages, or losses caused by improper use, misuse, unauthorized modifications, failure to follow instructions, or use of damaged equipment.

12. Limitation of Liability

12.1 Disclaimer of Warranties

Our Services are provided "AS IS" without warranties of any kind. We disclaim all warranties, express or implied, including:

  • Merchantability

  • Fitness for particular purpose

  • Non-infringement

  • Uninterrupted or error-free service

12.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits, data, or business opportunities

  • Personal injury or property damage

  • Damages exceeding the amount paid for our products/services

12.3 Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

  • Your use of our Services

  • Violation of these Terms

  • Infringement of third-party rights

  • Your negligent or wrongful conduct

13. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles.

14.2 Arbitration

Any disputes arising from these Terms or use of Services shall be resolved through binding arbitration, except:

  • Claims for injunctive relief

  • Small claims court matters

  • Intellectual property disputes

14.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

15. Miscellaneous

15.1 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RipFit180 regarding use of our Services.

15.3 Assignment

We may assign these Terms or any rights hereunder without notice. You may not assign your rights or obligations under these Terms.

15.4 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

15.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or government actions.

17. Effective Date and Acknowledgment
